California Law has recently codified pretrial diversion for low end drug possession offenses. (Penal Code Section 1000.) Until recently, persons arrested for having as little as .01 grams of a controlled substance had two options, a trial or entering a plea. The later would leave the indelible mark of a criminal record. For those individuals striving to become a United States Citizen, any type of plea could result in denial of naturalization.
Now, persons finding themselves charged with petty drug offenses have the opportunity to pretrial diversion. This program requires participants to undergo drug education, drug testing and a period of probation. The charges can be dropped once the probationary period is over (assuming no further violations occurred and the education and testing was successfully completed).

]]>Starting in 2015, criminal courts have began to implement a new diversion program for military veterans. This program applies to individuals charged with a misdemeanor and both of the following apply: (1) The individual was, or currently is, a member of the United States military and (2) The individual may be suffering from sexual trauma, traumatic brain injury, post-traumatic stress disorder, substance abuse, or mental health problems as a result of his or her military service. (Cal. Penal Code Section 1001.80)
A major benefit to this program is the lack of long term criminal record should one successfully completes the program. Per section (i) of Penal Code 1001.80, “Upon successful completion of a diversion program, the arrest upon which the diversion was based shall be deemed to have never occurred. The defendant may indicate in response to a question concerning his or her prior criminal record that he or she was not arrested or diverted for the offense, except as specified in subdivision (j). A record pertaining to an arrest resulting in successful completion of a diversion program shall not, without the defendant’s consent, be used in any way that could result in the denial of any employment, benefit, license, or certificate.” The exception mentioned above applies to applicants for peace officer jobs.

]]>Drinking and driving is dangerous. So much so, that the district attorney and courts are allowed to use your prior driving under the influence convictions to increase the sentence on a pending DUI case. Individuals who have two prior DUI’s can be sentenced to up to one year in jail. A fourth DUI conviction in ten years can be charged as a felony. It carries up to three years in jail. If someone other than the driver is injured, even in your first DUI case, you can also be sentenced to up to three years in jail.
Luckily, there are DUI jail alternatives to serving lengthy sentences. If you are not going to win your driving under the influence case by fighting the facts, it is a good idea to consult your attorney. You can discuss options available to you other than jail.
By far the most widely accepted alternative to jail is a residential treatment program. There are many programs available for those with special needs. These include young children or the absolute need to keep working. Also, most jurisdictions have alternative courts which provide intensive probation but limited incarceration time. Members of the San Mateo Police Department had illegally entered a rental unit owned by client. The police had obtained the consent of the landlord but never the client/tenant himself. Since client has exclusive control and rights over his residence, the entry was illegal and the evidence was thrown out.
